Terms of Service
Last updated: October 17, 2026
1. Acceptance of Terms
By accessing or using VinCheck services, operated by Softwave LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any changes.
2. Service Description
VinCheck provides vehicle history reports based on Vehicle Identification Numbers (VINs). Our reports compile information from various sources including:
- NMVTIS (National Motor Vehicle Title Information System)
- State DMV records
- Insurance claim databases
- Auction records
- Service and maintenance records where available
3. Account Registration
To purchase reports, you may create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account use
- Accept responsibility for all activities under your account
4. Payment Terms
All purchases are processed securely through Stripe. By making a purchase, you agree that:
- All payment information provided is accurate
- You are authorized to use the payment method
- Reports are delivered digitally immediately after purchase
- Prices are subject to change without notice
4.1 Subscription & Auto-Renewal Terms
We offer two optional auto-renewing monthly subscriptions: Subscribe & Save (vehicle history reports) and Window Sticker Unlimited. By choosing one you understand and agree that:
- Price and reports: Subscribe & Save is billed monthly at the price shown at checkout (35% off the one-time price) and adds twice the reports to your account every month: 2 reports for $12.99, 6 for $18.19 or 10 for $22.74. There is no trial; the first charge is taken when you subscribe.
- Recurring billing: Subscriptions renew automatically at the end of each billing period and your payment method is charged the then-current rate until you cancel.
- Cancel anytime: You can cancel in one click from Account → Billing at any time; cancelling stops all future renewals.
- No surprise charges: The renewal price, number of reports, billing interval, and cancellation method are disclosed on the pricing page and at checkout before you pay.
- Window Sticker Unlimited ($1 trial): The plan starts with a $1, 3-day trial that includes up to 5 window stickers. Unless you cancel before the trial ends, it automatically converts to a recurring subscription billed at $39/month to the payment method you used for the trial, every month until you cancel, and includes 70 stickers per billing month (up to 8 per day). Cancel during the trial and you are not charged the $39. When the manufacturer publishes a vehicle's original label you receive it unchanged; otherwise you receive a spec sheet rebuilt from VIN data, labeled as such.
- Earlier plans: The Unlimited reports plan is no longer sold; existing subscribers keep it until they cancel. It includes 80 full reports per billing month (up to 10 per day). Allowances reset at each renewal. These ceilings exist to prevent automated scraping and reselling — genuine individual use rarely approaches them.
- One-time purchases (1, 3 or 5 reports) are single charges and do not auto-renew.
4.2 Recurring Billing Authorization
When you start a subscription, you expressly authorize VinCheck (Softwave LLC) and our payment processor, Stripe, to securely store your payment method and automatically charge it — the trial activation fee today, and then the disclosed recurring price at the start of each billing period — until you cancel. This authorization remains in effect until you cancel. Each renewal is charged using the same authorization you provide at checkout, where you also accept these Terms. Charges appear as REPKITE* VINCHECK on your card statement. We confirm every subscription start, renewal, and cancellation by email.
4.3 How to Cancel
You can cancel at any time in one click from Account → Billing (vincheck.it.com/account/billing) or by emailing [email protected]. Cancelling stops all future charges immediately, including the first $39 charge if you cancel during a trial. There is no cancellation fee.
4.4 Chargebacks & Fair Dispute Resolution
If you believe a charge is incorrect, please contact [email protected] first — we resolve billing questions quickly and grant eligible refunds under our Refund Policy. Because our pricing, renewal amount, billing interval, and one-click cancellation method are all clearly disclosed before you pay, and your acceptance of these Terms is recorded at checkout, initiating a bank chargeback for a charge that matches these disclosed terms — rather than contacting us or cancelling — is a breach of this agreement. In response, we may submit to your bank and card network the record of your purchase, your recorded acceptance of these Terms, product delivery and access logs, and our cancellation and refund disclosures as evidence, and we may suspend the associated account.
5. Report Accuracy Disclaimer
While we strive to provide accurate information, please understand:

9. ClearVin Data Services
VinCheck is partnered with ClearVin, an approved NMVTIS (National Motor Vehicle Title Information System) data provider. By using our vehicle history report services, you acknowledge and agree to the following terms regarding ClearVin services:
9.1 Limitations on Use
You acknowledge and agree that ClearVin Vehicle Reports are provided solely for your internal use purposes. The reports are intended to assist you in making informed decisions about vehicle purchases and are not to be used for any other commercial purposes, resale, or redistribution without prior written consent.

You hereby waive any and all claims against ClearVin for any losses, damages, or liabilities arising from your use of ClearVin Vehicle Reports. ClearVin shall not be responsible to indemnify any losses as described in the service agreement. 9.3 Proprietary Rights and Copyrights
You acknowledge that ClearVin owns all rights, title, and interest in and to the ClearVin services, including all intellectual property rights, trademarks, and copyrights. You agree to protect the proprietary nature of the ClearVin Report and acknowledge the validity of ClearVin's copyrights. Any unauthorized reproduction, distribution, or modification of ClearVin reports is strictly prohibited.
9.4 NMVTIS Consumer Access Product Disclaimer
The National Motor Vehicle Title Information System (NMVTIS) is an electronic system that contains information on certain automobiles titled in the United States. NMVTIS is intended to serve as a reliable source of title and brand history for automobiles, but it does not contain detailed information regarding a vehicle’s repair history. All states, insurance companies, and junk and salvage yards are required by federal law to regularly report information to NMVTIS. However, NMVTIS does not contain information on all motor vehicles in the United States because some states are not yet providing their vehicle data to the system. Currently, the data provided to NMVTIS by states is provided in a variety of time frames; while some states report and update NMVTIS data in “real-time” (as title transactions occur), other states send updates less frequently, such as once every 24 hours or within a period of days. Information on previous, significant vehicle damage may not be included in the system if the vehicle was never determined by an insurance company (or other appropriate entity) to be a “total loss” or branded by a state titling agency. Conversely, an insurance carrier may be required to report a “total loss” even if the vehicle’s titling-state has not determined the vehicle to be “salvage” or “junk.” A vehicle history report is NOT a substitute for an independent vehicle inspection. Before making a decision to purchase a vehicle, consumers are strongly encouraged to also obtain an independent vehicle inspection to ensure the vehicle does not have hidden damage. The Approved NMVTIS Data Providers (look for the NMVTIS logo) can include vehicle condition data from sources other than NMVTIS. NMVTIS data INCLUDES (as available by those entities required to report to the System):
- Information from participating state motor vehicle titling agencies.
- Information on automobiles, buses, trucks, motorcycles, recreational vehicles, motor homes, and tractors. NMVTIS may not currently include commercial vehicles if those vehicles are not included in a state’s primary database for title records (in some states, those vehicles are managed by a separate state agency), although these records may be added at a later time.
- Information on “brands” applied to vehicles provided by participating state motor vehicle titling agencies. Brand types and definitions vary by state but may provide useful information about the condition or prior use of the vehicle.
- Most recent odometer reading in the state’s title record.
- Information from insurance companies, and auto recyclers, including junk and salvage yards, that is required by law to be reported to the system, beginning March 31, 2009. This information will include if the vehicle was determined to be a “total loss” by an insurance carrier.
- Information from junk and salvage yards receiving a “cash for clunker” vehicle traded-in under the Consumer Assistance to Recycle and Save Act of 2009 (CARS) Program.
Consumers are advised to visit www.vehiclehistory.gov for details on how to interpret the information in the system and understand the meaning of various labels applied to vehicles by the participating state motor vehicle titling agencies.
9.5 NVS Data Disclaimer
The ultimate source of the lien information available through ClearVin vehicle history reports is provided by the National Vehicle Service (NVS). Although every effort is made to ensure the accuracy of transmission and data, the reports are provided "as is." Some lien holders and jurisdictions do not report to NVS. Records from NVS may be incomplete. ClearVin makes no warranty either expressed or implied as to the validity of the NVS data. Other than that, data provided is a true and correct reproduction of the NVS data.
10. Electronic Communications & Consent
By creating an account or making a purchase, you consent to receive communications from us electronically — including receipts, renewal notices, service notices, and legal disclosures — by email or through your dashboard, and you agree that these electronic communications satisfy any legal requirement that such communications be in writing (E-SIGN Act). Transactional messages (receipts, renewal reminders, cancellation confirmations, and security notices) are part of the service and are sent regardless of marketing preferences. You may opt out of marketing email at any time using the unsubscribe link.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws rules. You agree to first attempt to resolve any dispute informally by contacting [email protected]; most issues are resolved within a few business days.
Any dispute that cannot be resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration body, seated in Albuquerque, New Mexico, United States, rather than in court, except that either party may bring an individual claim in small-claims court. To the fullest extent permitted by law, disputes will be resolved on an individual basis and you and VinCheck waive any right to participate in a class, collective, or representative action.
Nothing in this section limits your statutory consumer rights where they cannot be waived, or your right to the refunds described in our Refund Policy.
